Can a Trademark Application be opposed?

The following can be grounds for opposition:

  • proprietary rights or conflicting earlier registration
  • non-proprietary rights such as descriptiveness and non-distinctiveness
  • bad faith
  • breach of copyright
  • rights of notorious or well-known marks
  • rights in a company name
  • rights in trade names
  • registered design rights
  • rights in a personal name
  • unauthorized use of specially protected emblems or national insignia
